  • Financial Information: Bank account details, routing numbers, refund transfer details, income/expense data, and payment tokens processed through Stripe or TaxWise.

  • Tax Information: W-2s, 1099s, prior tax returns, dependent and deduction data, and other documents provided for tax filing.

  • Communications: Email, SMS, and uploaded files exchanged with our team.

  • Technical Information: Device, IP address, and usage logs for portal access and account security.

2. How We Collect Information

We collect data directly from you when you:

  • Complete online forms or scheduling pages.

  • Upload information to the Smartwiz Tax Organizer or client portal.

  • Communicate with us by phone, text, or email.

  • Provide consent through written, verbal, or electronic agreements.

We may also collect data from:

  • Authorized third parties such as 3Fund/Santa Barbara TPG (for pay-from-refund bank products), the IRS, and state tax agencies.

3. How We Use Information

We use your information to:

  • Prepare and e-file federal and state tax returns.

  • Verify your identity and prevent fraud.

  • Communicate service updates, document requests, or scheduling reminders.

  • Process payments via Stripe or TaxWise.

  • Provide audit defense and bank product support.

  • Comply with applicable laws and IRS regulations.

4. How We Share Information

We share information only as necessary to perform services or comply with legal obligations, including with:

  • IRS and state tax authorities for filing purposes.

  • TaxWise for tax preparation and e-filing.

  • Smartwiz for secure client portal and document management.

  • 3Fund/Santa Barbara TPG for refund processing.

  • Stripe for secure payment processing.

  • ProtectionPlus or other audit defense providers, when applicable.

  • Go High Level / LeadConnector (Twilio) and email tools for client communications.

We do not sell or rent personal information to third parties.

5. Use and Disclosure of Tax Return Information (IRC §7216)

We will not disclose or use your tax return information for purposes other than preparing, assisting in preparation, or providing services directly related to your tax return, unless you provide prior written consent as required by Internal Revenue Code §7216.

6. SMS and Electronic Communications (TCPA/A2P)

By providing your phone number, you consent to receive SMS or email communications from us regarding appointments, document requests, updates, and limited promotional content.

  • Message & data rates may apply.

  • Reply STOP to opt out or HELP for assistance.

  • Consent to receive messages is not required to purchase services.

All communications are logged and secured in compliance with TCPA and A2P 10DLC regulations.

7. Safeguards and Security (GLBA Compliance)

We maintain a written Information Security Program under the Gramm-Leach-Bliley Act (GLBA) to protect nonpublic personal information.

  • Data is encrypted in transit and at rest.

  • Access is restricted to authorized personnel.

  • Multi-factor authentication is required for staff logins.

  • Vendors undergo due diligence and data security reviews.

8. Retention and Disposal

We retain tax records and supporting documentation for at least seven (7) years or longer as required by IRS or state regulations.
Non-tax communications and logs may be retained up to 24 months.
Records are securely deleted or destroyed when retention periods expire.

9. California Privacy Rights (CPRA)

California residents have the right to:

  • Know what personal information we collect and how we use it.

  • Request access, correction, or deletion of their data.

  • Opt out of disclosure for cross-context advertising (we do not sell data).

10. Cookies and Website Data

We may use functional cookies or analytics tools to improve site performance.
We do not currently use behavioral advertising or third-party ad pixels.

Our services are intended for adults. We do not knowingly collect information from children under 13. Dependent data is collected only from parents or guardians for tax filing purposes.

  • Request a copy of your data or ask for corrections.

  • Withdraw consent for SMS or marketing at any time.

  • Delete your account or documents (subject to legal retention rules).
